Terms of Service

These Terms of Service ("Terms") govern access to and use of InfiBot, an AI chatbot platform, and all related websites, dashboards, APIs, and embeddable widgets (collectively, the "Service"), provided by Infi Web Solutions ("Infi Web Solutions", "we", "us", or "our"). By creating an account, checking the acceptance box during signup, or otherwise accessing or using the Service, you ("you", "your", or "Customer") agree to be bound by these Terms. If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity, in which case "you" refers to that entity.

If you do not agree to these Terms, do not create an account or use the Service.

1. The Service

InfiBot lets you create and configure AI-powered chat widgets ("Bots") for your website or other channels. Depending on your plan, this may include: importing knowledge from a website you provide, PDF documents, or other sources; choosing an AI provider and model to generate responses; customizing the Bot's appearance and behavior; capturing leads; routing conversations to a human agent ("handover"); and connecting third-party integrations such as WhatsApp or Google Sheets. Features, limits, and availability vary by plan and may change as described in Section 4.

2. Accounts & Eligibility

You must provide accurate, current information when creating an account and keep it up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must be at least 18 years old, or the age of legal majority in your jurisdiction, and have the authority to enter into these Terms. You are responsible for the actions of any team member you invite to your account.

3. Plans, Billing & Free Plan

The Service is offered under multiple plans, including a Free plan with reduced limits and functionality. We may change plan features, limits, and pricing at any time, including which features are available on the Free plan; where reasonably possible we will provide notice of material changes affecting existing paid subscriptions. Paid plans are billed in advance on a recurring basis through our payment processors. Except where required by law, fees are non-refundable. We may suspend or downgrade access if a payment fails or a subscription lapses. We reserve the right to disable or restrict specific functionality (such as embedding a Bot on an external website) for Free-plan accounts at any time.

4. Your Content

"Customer Content" means any content you submit to the Service, including website URLs you ask us to crawl, PDF files or other documents you upload, system prompts and instructions you write, and data collected through your Bot's conversations with your visitors. You retain all ownership rights in your Customer Content. You grant us a worldwide, non-exclusive license to host, store, process, transmit, and display your Customer Content solely as necessary to provide and improve the Service to you.

You are solely responsible for your Customer Content and for having the right to submit it, including any website content you direct us to crawl and any personal data collected from your visitors through the Service. You must comply with applicable law, including data protection and privacy law, in connection with your use of the Service and any data you collect through it.

5. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable law or regulation, or the rights of any third party;
  • Upload, crawl, or transmit content that is unlawful, defamatory, fraudulent, or infringes intellectual property or privacy rights;
  • Transmit malware, or attempt to gain unauthorized access to the Service or other accounts;
  • Interfere with or disrupt the integrity or performance of the Service;
  • Use the Service to send unsolicited communications or spam;
  • Reverse engineer, decompile, or attempt to extract the source code of the Service, except as permitted by law;
  • Resell or provide the Service to third parties as a stand-alone competing service without our written consent.

We may investigate and take appropriate action, including suspending or terminating accounts, for any use of the Service that we reasonably believe violates these Terms.

6. AI-Generated Content & Limitations

The Service uses third-party and other AI models to generate Bot responses based on the knowledge sources, prompts, and settings you provide. AI-generated responses may be inaccurate, incomplete, or inappropriate for your use case. You are responsible for reviewing and testing your Bot's configuration and behavior before relying on it for your business, and for how you present AI-generated responses to your visitors. We do not guarantee the accuracy, reliability, or fitness for any particular purpose of AI-generated content.

7. Third-Party Providers & Integrations

The Service integrates with third-party providers, including AI model providers (such as OpenAI, Anthropic, Google, and DeepSeek), messaging platforms (such as WhatsApp), and productivity tools (such as Google Sheets). Your use of these integrations is also subject to the applicable third party's own terms and policies. We are not responsible for the availability, performance, or content of third-party services, and any information you provide to configure an integration (such as API keys or access tokens) is your responsibility to keep secure.

8. Intellectual Property

The Service, including its software, design, and branding (excluding your Customer Content), is owned by Infi Web Solutions and its licensors and is protected by intellectual property laws. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business purposes, including embedding your Bot's widget script on websites you own or operate as permitted by your plan.

9. Confidentiality

Each party may have access to non-public information of the other party in connection with the Service. Each party agrees to use the other's confidential information only as necessary to perform its obligations under these Terms and to protect it with reasonable care, except where disclosure is required by law.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that AI-generated responses will be accurate or suitable for your intended use.

11. Limitation of Liability

To the maximum extent permitted by law, Infi Web Solutions will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service, even if advised of the possibility of such damages. Our total aggregate liability for any claim arising out of or relating to these Terms or the Service will not exceed the amount you paid us for the Service in the twelve (12) months preceding the event giving rise to the claim.

12. Indemnification

You agree to defend, indemnify, and hold harmless Infi Web Solutions and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your Customer Content, your use of the Service in violation of these Terms, or your violation of any law or third-party right.

13. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access to the Service, with or without notice, if you materially breach these Terms, fail to pay applicable fees, or if we reasonably believe your use of the Service poses a risk to us, other users, or third parties. Upon termination, your right to use the Service ends immediately; we may delete your Customer Content after a reasonable period following termination, except where we are required to retain it by law.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice, such as by posting the updated Terms on this page with a new effective date, or by other reasonable means. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of India, without regard to its conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts located in Ludhiana, Punjab, India.
